Child support modifications sometimes necessary

Child support is a bill that needs to be paid and paid on time. Missing child support payments is not an option in the eyes of the court. Because child support is for the benefit and welfare of the child, courts take these payments very seriously. Children are often the innocent victims in divorce cases and their protection is paramount, which is why courts use mandated state guidelines in determining child support payment amounts.

Many times, those who pay child support have a change in their financial circumstances. In these cases, a child support modification request is a viable option. This modification request is made in court. The request is based on a significant change in the financial status of the person paying child support so that paying the support payments is or will cause a financial hardship to the individual. The courts take all of the information that is provided into consideration and make a ruling on the request for modification that is appropriate.

Just like child support payments can be modified to decrease payments, they also can be modified to increase payments if that is what is indicated by the applicable support guidelines.

In Kentucky, a former University of Kentucky basketball player requested a child support modification because he lost an election last year, and his term as an agricultural commissioner ended. Also, the man made the request because he is scheduled to have surgery and will be incapacitated for some time. The court has not yet made a determination in this particular case.

Like Kentucky, Michigan courts also allow for individuals to request child support modifications. Although, the courts take into account all of the facts and circumstance that are relevant and in place at the time of the divorce decree or child support order, a change in circumstances can justify modifying the order of child support. There is no set number of times that a child support modification can be requested, although many states place some limits on the ability of an obligor to request a modification. The courts look at each request on a case-by-case basis.
